(Terms)

1.
INTRODUCTION
|
|
|
1.1
These are the Terms upon which we accept internet E-PARK
bookings on this website.
|
|
| 1.2
It is important that you read and understand these Terms
before making your E-PARK booking. By making your E-PARK
booking on this site, you accept to be bound by these Terms.
|
|
| 1.3
These Terms (which includes the additional sign posted
conditions of parking that are
|
| displayed
at the entry to each Car Park) also set out the rules that you must
follow when you park your |
| Vehicle
in any of the Sydney Airport Corporation Car Parks. |
|
|
2.
DEFINITIONS
|
|
|
In these Terms the
following words or phrases have these
meanings:
|
|
|
The words " we”,” us” or” our" means Sydney Airport
Corporation Limited (ABN 62 082 578
809).
|
|
|
The words "you” or “your" means any person who
makes an E-PARK booking or (where the context allows) uses a Car
Park for the parking of a Vehicle.
|
|
| "Booking
Period" means the
period commencing on the date that you specify for the date of entry
to the Car Park, and ending on the date that you specify for leaving
it.
|
|
|
"Car
Park" means any car
park controlled by us.
|
|
|
“Contract” means the
contract formed between you and us from the time that you receive
the E-PARK Receipt (which Contract includes our standard additional
terms and conditions that are posted on any sign at the entrance to
the Car Park).
|
|
|
"Parking
Rates" means the
rates and charges stated on any board or notice at a Car
Park.
|
|
|
“Receipt” means the emailed
confirmation from us that your E-PARK booking has been
accepted.
|
|
|
"
Valet
Park" means a method of
parking whereby you leave the keys to your Vehicle with us or with
our appointed contractor so that we can park your Vehicle in a space
that we select.
|
|
|
"Vehicle" means any vehicle
which you may park in a Car Park and includes any mechanical device
on wheels or tracks, its equipment and
accessories.
|
|
|
3.
INTERPRETATION
|
|
|
3.1
Acceptance of these Terms - If you make an E-PARK
booking on this site then you accept these Terms without
qualification.
|
|
|
3.2
Exclusion of variations - These Terms apply to
the exclusion of any other conditions. None of our employees,
servants or agents has authority to vary or waive these Terms.
|
|
|
3.3
Sign posted conditions of parking - Additional conditions
for parking in the Car Park are displayed at the entry to each Car
Park. Those sign posted
conditions are in addition to and form part of these Terms. If there is any
inconsistency between these Terms and those sign posted at the
entrance to the Car Park, then these Terms will take precedence.

3.4
Amendment to these Terms – These Terms may be
changed by us at any time and such changes will apply to all E-PARK
bookings made after such amendments have been posted on this
website.
|
|
|
3.5
Statutory Rights - Nothing in these
Terms affects your statutory rights
|
|
|
3.6
Headings - Headings are for
information only and do not affect the interpretation of these
Terms.
|
|
|
3.7
Copyright - All copyright in
these Terms and any material contained on the E-PARK website is the
property of Sydney Airport Corporation Limited (ABN 62 082 578
809).
|
|
|
3.8
Apply NSW law - These Terms and any
Contract is governed by and will be construed in accordance with the
laws in force in
New South
Wales
and the parties submit to the
jurisdiction of its courts.
|
|
|
4.
REQUIREMENTS
|
|
|
4.1
Please read these Terms carefully - You will need to read
and confirm that you have read these Terms before booking your
E-PARK space on this site.
You will be bound by them once your E-PARK booking is
confirmed.
|
|
|
4.2
E-PARK Booking Receipt - An E-PARK booking is
confirmed when we email you your Receipt to the email address you
gave us on the website booking form. When you receive your
Receipt you should check that the information on the Receipt is
correct and let us know by email at park@syd.com.au if it is
not. You must quote the
booking reference number on the Receipt if you wish to contact us
about your E-PARK booking.

4.3
Use and transfer of E-PARK spaces - The E-PARK booking
and the resultant Contract is personal to you, and can only be used
by you or someone authorised by you.
|
|
|
4.4
Size and height restrictions - We only accept E-PARK
bookings for cars, light utes and light vans. Size and height restrictions
apply at some of our Car Parks. You should ensure that the
Car Park you have chosen is suitable for your Vehicle’s size and
height. Please contact
us park@syd.com.au if you wish
to check whether your Vehicle is acceptable. Please note that you are not
entitled to a refund if your Vehicle exceeds our size or height
limits.

4.5
Change of Vehicle specifications - When you book your
E-PARK space, you must specify the registration number of the
Vehicle. Your E-PARK
booking will only be valid for the Vehicle that has the specified
registration number that you have booked for. You must change these
details if you wish to use the E-PARK for another vehicle. There is
no additional fee if you change these details before your booked
arrival time. These
details can be changed by emailing us at park@syd.com.au .

5.
PAYMENT
|
|
|
5.1
Payment by Credit Card - You must pay for your
E-PARK space by using any acceptable credit card set out on the
website booking form.
We may charge an additional fee for such payment by credit
card, which may vary depending on which card you use. We do not accept payment by
cash or cheque.
|
|
|
5.2
Booking fee – Your E-PARK booking
will incur a $2 non refundable booking fee when the E-PARK booking
is made.
|
|
|
5.3
Failure of payment - Your E-PARK booking
may be cancelled by us if your credit card payment fails. If we cancel your booking for this
reason, then we will still charge you a
$5 administration
fee and the $2 booking fee.
|
|
|
5.4
Payment policy - By booking on our
website you agree that:
|
|
|
a.
The E-PARK space will be charged to you for each calendar
day (or part thereof) of the Booking Period;
|
|
|
b.
No refund will be made if your stay is shorter than the time
specified in the Booking
Period;
|
|
|
c.
If you arrive early or leave late (so
that your Vehicle is parked in the Car Park for any period of time outside
your Booking Period), then you will be charged for the additional
period you are in the Car Park at the sign posted Parking Rates
specified at the entrance to that Car Park. Any such additional charge
will be payable, even if your total stay is no longer than the
Booking Period; and

d.
The parking rate that you will be charged for any extra stay
will be the rate that would have been charged for that extra time
had you not booked your E-PARK space.
|
|
|
5.5
Price includes GST - The price that you
have been quoted for the E-PARK space includes GST and is fixed when
you make your E-PARK booking.
No further discounts apply.
|
|
|
6. CANCELLING YOUR
E-PARK BOOKING
|
|
|
6.1
24 hour notice of cancellation to receive a
refund - You may cancel your
E-PARK booking, for any reason, at any time up to 24 hours prior to
the start of the Booking Period. If you cancel with at least
24 hour notice, then you will receive a refund, less a $5
administration fee and the $2 booking fee.
|
|
|
6.2
Cancellation must be by email - To cancel your E-PARK
booking, you must contact us by email at park@syd.com.au quoting your name,
address, vehicle registration, booking Receipt number and Booking
Period. Cancellations
will only be accepted by email.
|
|
|
6.3
Refunds policy – There will be no
refund for your E-PARK booking if you:
|
|
|
a.
Do not cancel your
E-PARK booking 24 hours before the start of the Booking Period;
or
|
|
|
b.
Do not use the E-PARK booking.
|
|
|
7. STEPS TO
FOLLOW
|
|
|
7.1
Print out your Receipt and bring it with you to the
airport.
|
|
|
7.2
Take a Car Park entry ticket on entering Car
Park – On entering the Car
Park, press the button on the ticket machine and take the usual Car
Park entry ticket.
|
|
|
7.3
“Reserved Pre-booked Customers Only” Car Park
spaces – You may park your
Vehicle in the parking spaces marked “Reserved Pre-Booked Customers
Only”. If no such
spaces are available then you can park in any “non-reserved” parking
spaces in the Car Park.
|
|
|
7.4
Present your Receipt to the cashier as you exit the Car
Park – Please keep the Car
Park entry ticket you received on entering the Car Park. On exiting the Car Park with
your Vehicle, present this Car Park entry ticket and your E-PARK Receipt to the cashier. The Receipt is your proof of
an E-PARK booking and payment.

7.5
Pay additional charges - You may have to pay
an additional parking fee if you entered the Car Park before your
specified booking time or if you return to the Car Park after expiry
of the specified time.
These additional fees will be based on the Parking Rates
displayed at the entrance to the Car
Park.
|
|
|
7.6
Forgotten or lost Receipt - If you forget to
bring your Receipt to the Car Park or you loose your Receipt, then
you should contact the cashier or our staff when you first enter the
Car Park. While you are
away, the cashier will use its best endeavours to confirm your
E-PARK booking on our database by your
return.
|
|
|
7.7
Please Check-in 60 Minutes Prior to Your Airline Check-in
Time - It is your
responsibility to ensure that you leave enough time to get from your
Vehicle to the terminal check-in counter. If the Car Park you have
selected to use is the Remote Long Term Car Park then a free shuttle
bus will transfer you to the domestic terminals. You must allow for
delays in waiting for transport between the Car Park and the airport
terminal. You should
arrive at the Car Park at least 60 minutes prior to your airline’s
required check-in time to allow for transfer from the Car Park to
the airport terminal.
The P-Bus timetable is available online at www.sydneyairport.com.au
. Please note, the P-Bus operates transfers to domestic terminals T2
and T3 only. If your flight departs from T1 (international terminal)
please allow additional time to transfer from T2 or T3.

7.8
How to contact Car Park staff – Please note that if
you need to contact our Car Park staff while you are in the Car
Park, that there is a help button on the Car Park ticketing machine
at the entrance to the Car Park and on all Car Park pay
machines.
|
|
|
8. YOUR ENTITLEMENT
TO PARKING
|
|
|
8.1
Reasonable endeavours - We will use
reasonable endeavours to ensure that an E-PARK space is available at
the Car Park you nominated but availability of an E-PARK space is
not guaranteed. If the
relevant car parking is not available, then the following will
apply:

|
|
8.2
If all E-PARK spaces are full in your nominated Car
Park– If there are no
parking spaces marked “Reserved Pre-Booked Customers Only” then you
can park in any non-reserved parking spaces in that Car
Park.
|
|
|
8.3
If your nominated Car Park is full – If we can not accommodate you in
your
chosen Car Park for the Booking Period;
|
|
|
a.
Then we will endeavour to upgrade you, at no additional
charge, to another type parking in one of our other Car
Parks; and
|
|
|
b.
If we are unable to upgrade you and you are required to use a
cheaper parking option
(according to the sign posted Parking Rates at the Car Park
entrance) than the
cost of the E-PARK space you booked, then we will refund you
the price difference.
|
|
|
8.4
If all our
Car Parks are
full – In the unlikely event
that we can not accommodate your Vehicle at any of our Car Parks,
then;
|
|
|
a.
If available, we will organise alternative arrangements at
our cost; or
|
|
|
b.
You will be entitled to a full refund of your E-PARK booking
fee.
|
|
|
9.
LIABILITY
|
|
|
9.1
Substitution and/or refund is your only
remedy - If we can not
accommodate your Vehicle for any reason, then you agree that such
substitute parking and/or refund referred to in section 8, will be
your only remedy against us.
Subject to any law to the contrary, this will be the limit of
our liability to you under the Contract.
|
|
|
9.2
Our liability for you or your Vehicle - We will
not be liable to you for any loss or damage that you or your Vehicle
may suffer unless the loss or damage is proven to be caused by the
negligence, wilful act, default or breach of statutory duty by us,
our employees, servants or agents.
|
|
|
9.3
Our liability for your luggage or property - We will
not be liable to you for any loss or damage to your luggage or other
property whilst in any Car Park or on the transport between a Car
Park and the terminal, unless the loss or damage is proven to be
caused by the negligence, wilful act, default or breach of statutory
duty by us, our employees, servants or
agents.

|
9.4
No liability for delays or missed flights – You agree
that we have no liability to you if you miss your flight, even if
the delay is due to traffic congestion within or near the airport,
or due to the advertised frequency of transport from the Car Park to
the terminal not being maintained for any reason. We also give no guarantee as
to the frequency of transport between the Car Park and the
terminal.

|
9.5
Consequential losses – We will also not be
liable to you for any special, incidental, indirect or consequential
loss or damage suffered by you as a result of a breach by us of our
obligations under these Terms and the Contract, whether we could
have foreseen such losses or damages at the
time.
|
|
|
9.6
Your liability to us – You indemnify us for
any cost, expense, loss or damage suffered by us in connection with
any death or personal injury of any person or any damages to any
real and personal property caused directly or indirectly by you or
your agent’s use of the Vehicle in the Car
Park.
|
|
|
9.7
No limitation - Despite any other
provision in these Terms, we do not exclude or limit the application
of any statute where to do so would contravene that statute or cause
any part of the Contract to be void. Nothing in these Terms
limits our liability for personal injury or death to the extent
caused by a negligent act or omission of us.
|
|
|
9.8
Trade practices requirements - Where the Trade
Practices Act 1974 or other laws imply conditions or warranties in
respect of this Contract and it is not lawful or possible to exclude
them, our liability for any breach of such condition or warranty
will be limited to the extent permitted by law, and at our option to
the supplying of the services again or the payment of the cost of
having the services supplied again.

|
10. FORCE
MAJEURE
|
|
|
We are not liable for
any delay or failure to perform our obligations under this Contract
if such delay or failure is caused or contributed to by a Force
Majeure. In this
section Force Majeure means a circumstance beyond our reasonable
control and which results in our being unable to observe and perform
on time any obligation under this Contract. If a delay or failure by us
to perform our obligations is caused or contributed to by a Force
Majeure, the performance of our obligations will be suspended.

11. VALET
PARKING
|
|
|
We reserve
the right to
Valet
Park your
Vehicle - We reserve the right
to
Valet
Park
your Vehicle and may
notify you of this before or on your arrival. If we elect to
Valet
Park
your
Vehicle, then this will be done at no additional cost to
you.
|
|
|
12. BOOKING MOBILITY PARKING
SPACES
|
|
|
Contact staff
on arrival for
mobility spaces - If
you require a “mobility parking scheme holder” space, then please
contact a member of the Car Park staff by pressing the help button
on the Car Park ticketing machine at the entrance to the Car Park on
your arrival at the Car Park.
|
|
|
13. COMMENTS AND
COMPLAINTS
|
|
|
Any comments or
complaints relating to the E-PARK booking procedure and these Terms
should be made in writing to us at our address below or by e-mail to
park@syd.com.au We endeavour to answer all
complaints within 5 working days. Please assist by providing
as much relevant information and detail as you can so that we have
the best opportunity to investigate and take action on your
complaint or comment.

14. PRIVACY
POLICY
|
|
|
By accepting these
Terms, you agree to be bound by our privacy policy which is

which outlineshow we manage
the personal information that we may collect and how you contact us
if you have any queries in regard to privacy
issues.
